(PUP-3912) Update use of pending to skip

This updates this one spec file for rspec3's changes re pending:

• replace conditional pending blocks with explicit if ... skip logic
• replace pending statements with skip statements

Also, I added a TODO comment to scrub this file. It's a mess and
if we stick with our decision to drop specs on Solaris this can be
cleaned up some more.
